Hey Scott,
Copyright is weird. Sometimes cut and dry, sometimes hazy at best. I scrolled thru some Reddit theorizing, but how did Sting never get sued for basically being The Crow then being Joker Sting? Not mention having tantric singer Sting after him for the name.
Seems like in entertainment people have been sued or had to pay for use over a lot less. Look how litigious WWF and WCW were in that time alone.

The singer is easy, because Steve Borden trademarked the name before Gordon Sumner did. Plus you can’t reasonably confuse the wrestler with the musician.
As for the Crow, you can’t really trademark “spooky white painted guy in a trenchcoat”. They weren’t claiming any connection to the Crow franchise so it’s like Spirit Halloween selling costumes of a hockey mask serial killer.
