DiBiase forgets to check the fine print?

So, mastermind DiBiase buys Andre's contract, pays for plastic surgery on a fake ref, but we're supposed to believe he somehow forgets to check the rule book to see if a title surrender is legal? Wouldn't it have made more sense (kayfabe) to hold the title up because of the FAKE REFEREE that in no way worked for the WWF and had no business being in the ring?

Related, the original plan was for DiBiase to win the WM4 tournament. But, in that scenario, why do a tournament at all? Let the Main Event title change and surrender stand. Then DiBiase is the heeliest heel who ever heeled. He's drawing nuclear heat. And a match with Hogan at WM4 surely draws huge money. They could do another screwy finish and then do a rematch at SummerSlam.
The plan was always for Hogan and Andre to have a rematch at WM4, but then it was going to be Dibiase defending against him at Summerslam. Hard to fault what we ended up with though.
